Company Fined $2,000 For Worker’s Death In Indiana

An Evansville, Indiana, manufacturing company has been fined by Indiana’s Department of Labor in connection with the death of a worker in August of 2010. According to reports from Channel 13 News, the company responsible for the death, Bootz Industries, was fined $2,000 by the department for their part in causing the accident.

Records show that the 49-year-old worker was killed when a forklift he was driving hit a sidewalk and flipped over on top of him. It was determined that the worker was not wearing a seat belt and may not have been safe to operate because of leaking fluid lines. These findings prompted the Indiana Department of Labor to investigate, who mandated a $3,500 fine to the company. The fine was later reduced to $2,000 after the company agreed to take the forklift out of service and retrain drivers on forklift safety and use in the next 30 days.

No civil action has been taken against the company in connection with the death of the worker, but the statute of limitations on wrongful death cases is two years.

Indiana Worker Injured In Snowplow-Train Collision

The Federal Railroad Administration (FRA) says that train accidents occur more often at intersections with no cross arms in front of the tracks. That was the case Wednesday morning when a Hendricks County employee was injured in a collision between his snowplow and a train. According to Channel 13 News, the incident occurred at a crossing with County Road 151 West.

The train’s conductor told sheriff’s deputies that he was heading west at around 45 MPH as he approached the intersection where the accident occurred. He said that the driver of the snowplow slowed his vehicle, but did not completely stop. The conductor attempted to stop the train as the snowplow crawled onto the tracks, but did not have enough time or distance to bring the train to a halt. The two collided and the snowplow rolled–trapping the driver inside.

He was freed by firefighters and paramedics a short time later and was taken to St. Vincent Hospital to be treated for injuries to his legs and arms.

Deputies confirmed that the crossing is marked with a stop sign and railroad crossing warnings, but no cross arm mechanism. According to the FRA, 171 people have died this year in highway-rail accidents.

Extreme Heat Causes Death of On-Duty Columbus Foundry Worker

A Bartholomew County coroner has determined that the Columbus, Indiana, man who died on Thursday, July 21, at his workplace died of a heart attack complicated by extreme heat.

The 50-year-old man from North Vernon, Indiana, collapsed at his workstation at CE Systems Inc., which makes iron castings for heavy equipment manufacturers. He had reportedly retreated to the a cool room earlier in the day to take a break from the heat, which reached the mid-90s that day.

The Bartholomew County Coroner’s Office found that the man was taking medication for hypertension and high cholesterol.

The Indiana Department of Labor is investigating the man’s death, which was not reported until Monday despite a requirement that all workplace deaths be reported within eight hours.

“We’ll take a look at everything from the workplace itself, where the employee was doing the work, what type of work the employee was doing,” said Department of Labor spokesperson Stephanie McFarland.

The man’s family told TheIndyChannel.com that they believe the death could have been prevented.

“They could have given him breaks,” said the man’s son. “They could have asked him to go home because of the heat. It gets about 180 degrees in there.”

An Indiana truck accident took the life of a local man early Saturday morning, the Palladium-Item reports.

The man was driving northbound on Indiana 227 when his vehicle drove off the side of the road.  The vehicle struck two mailboxes and a tree before partially ejecting the driver from the pick-up truck.

The victim was transported to a local hospital where he later died from injuries suffered in the Indiana auto accident.

Police report that alcohol was not a factor in this Indiana truck accident.
